本《服务条款》（以下简称"本条款"）是您与 Wenbo Qiu（以下简称"我们"）之间就您使用 猫头鹰账本（Spendome，以下简称"本应用"）所订立的协议。
请您在使用本应用前仔细阅读本条款。当您勾选同意、下载、安装或使用本应用，即表示您已阅读、理解并同意接受本条款的全部内容。如您不同意本条款，请勿使用本应用。
一、服务内容
本应用是一款智能个人收支记录与分析工具，通过文字或语音输入，借助大语言模型自动解析金额、分类和日期，并提供图表洞察、周期提醒、智能助手对话等功能。我们有权根据运营需要对服务功能进行调整、增加或减少，并会以适当方式予以公告。
二、免费额度与会员订阅
- 免费额度：我们为未订阅用户提供免费智能记账额度，该额度为终生累计而非每日重置：匿名使用可获得 10 次；免费注册并登录后再赠送 10 次，最多累计 20 次。额度规则可能根据运营情况调整。
- 会员订阅（Pro）：您可通过购买订阅获得无限次数的使用权益及其他 Pro 专属功能。订阅为自动续订，除非您在当前订阅期结束前至少 24 小时取消，否则将按周期自动续费。
- 支付与续订：订阅通过 Apple App Store 或 Google Play 完成支付，费用将由相应平台账户扣取。订阅的具体价格、周期以您下单时应用内及平台展示为准。
- 管理与取消：您可随时在 Apple／Google 账户的订阅管理中查看、变更或取消订阅。取消后，您仍可使用已付费周期内的 Pro 权益至到期为止。
- 退款：订阅退款适用并遵循 Apple App Store／Google Play 的退款政策，由相应平台处理。
三、账号与使用
- 您可通过 Apple 账号或游客方式使用本应用。您应对账号下的活动负责，并妥善保管登录凭证。
- 您承诺以您本人合法持有的身份信息进行注册与登录，不得冒用他人身份。
- 如发现账号被未经授权使用，您应及时通知我们。
四、用户行为规范
您在使用本应用时，不得利用本应用从事任何违法或侵害他人权益的行为，包括但不限于：
- 输入、生成或传播违反适用法律、含有暴力、淫秽、欺诈、仇恨或其他违法不当信息的内容；
- 侵犯他人知识产权、隐私权、名誉权等合法权益；
- 通过自动化脚本、批量请求、逆向工程等方式滥用、攻击或干扰本应用及其服务器的正常运行；
- 绕过、破解或规避免费额度、订阅校验等技术措施。
如您违反上述规定，我们有权视情节采取限制功能、暂停或终止服务等措施，并保留追究法律责任的权利。
五、自动生成内容免责
本应用的金额解析、分类建议、统计分析等内容由大语言模型自动生成，可能存在不准确、不完整或不恰当之处。相关内容仅供个人记账参考，不构成任何财务、税务、法律或其他专业建议。请您在作出财务决策前自行核实，因依赖自动生成内容所产生之后果由您自行承担。
六、知识产权
- 本应用及其包含的界面、商标、文字、图形、代码等，相关知识产权归我们或权利人所有，受法律保护。
- 未经我们书面许可，您不得复制、修改、传播、出售或以其他方式商业利用本应用的任何部分。
- 用户内容：您通过本应用输入或记录的账单内容，其权利仍归您所有。您授予我们为提供和改进服务所必需的、有限的使用许可（如传输、存储、同步）。
七、第三方服务
本应用集成了第三方服务（如应用商店支付、大语言模型等）。这些第三方服务受其各自条款与政策约束，我们对第三方服务的可用性与表现不承担责任。详见本应用《隐私政策》。
八、服务的变更、中断与终止
- 我们可能因升级、维护、第三方原因或不可抗力而暂停或中断服务，将尽合理努力提前告知；
- 我们有权基于法律或运营策略调整、暂停或终止全部或部分服务；
- 您可随时停止使用并注销账号。
九、免责声明与责任限制
- 本应用按"现状"和"现有"基础提供，我们不对服务绝对不中断、无错误或完全满足您的特定需求作出保证；
- 在适用法律允许的最大范围内，对于因使用或无法使用本应用而导致的间接、偶然或后果性损失，我们不承担责任；
- 本条款未尽事宜，以及我们对您承担责任的范围，均以适用法律的强制性规定为准。
十、条款的变更
我们可能适时修订本条款，并在本页面公布更新版本及"生效日期"。变更生效后您继续使用本应用，即视为您接受修订后的条款；如不同意，请停止使用。
十一、争议解决
因本条款或本应用产生的任何争议，双方应先以友好协商方式解决。本条款不影响您依所在国家／地区法律所享有的强制性消费者权利；该等强制性规定与本条款不一致时，以强制性规定为准。

- 繞過、破解或規避免費額度、訂閱核驗等技術措施。
如您違反上述規定，我們有權視情節採取限制功能、暫停或終止服務等措施，並保留追究法律責任之權利。
五、AI 生成內容免責
本應用程式的金額解析、分類建議、統計分析等內容由大型語言模型自動生成，可能存在不準確、不完整或不恰當之處。相關內容僅供個人記帳參考，不構成任何財務、稅務、法律或其他專業建議。請您在作出財務決策前自行核實，因依賴 AI 生成內容所產生之後果由您自行承擔。
六、智慧財產權
- 本應用程式及其包含的介面、商標、文字、圖形、程式碼等，相關智慧財產權歸我們或權利人所有，受法律保護。

These Terms of Service ("Terms") form an agreement between you and Wenbo Qiu ("we", "us") regarding your use of Spendome (the "App").
Please read these Terms carefully before using the App. By indicating consent, downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the App.
1. The Service
The App is an AI-powered personal income and expense tracking tool. You record transactions by voice or text; the App uses large language models to parse the amount, category and date automatically, and provides chart insights, recurring reminders and an AI assistant. We may adjust, add, or remove features as needed for operations, with appropriate notice.
2. Free Quota & Subscriptions
- Free quota: we provide non-subscribers a free AI-record quota that is a lifetime total, not a daily reset: anonymous use gives 10 records, and registering for a free account and signing in adds 10 more, up to 20 in total. Quota rules may change based on operations.
- Pro subscription: you may purchase a subscription for unlimited usage and other Pro-exclusive features. Subscriptions auto-renew; unless you cancel at least 24 hours before the end of the current period, they renew automatically each cycle.
- Payment & renewal: subscriptions are paid through the Apple App Store or Google Play and charged to your platform account. The applicable price and period are those shown in the App and on the platform at the time of purchase.
- Manage & cancel: you may view, change, or cancel your subscription anytime in your Apple/Google account's subscription management. After cancellation, you retain Pro benefits through the end of the paid period.
- Refunds: subscription refunds are subject to and handled under the Apple App Store / Google Play refund policies.
3. Account & Use
- You may use the App via your Apple account or as a guest. You are responsible for activity under your account and for safeguarding your credentials.
- You agree to register and sign in using identity information you lawfully hold, and not to impersonate others.
- If you discover unauthorized use of your account, you should notify us promptly.
4. Acceptable Use
When using the App, you must not engage in any unlawful activity or any activity that infringes others' rights, including but not limited to:
- entering, generating, or distributing content that violates applicable law or contains violent, obscene, fraudulent, hateful, or otherwise unlawful or improper material;
- infringing others' intellectual property, privacy, reputation, or other lawful rights;
- abusing, attacking, or interfering with the App or its servers via automated scripts, bulk requests, reverse engineering, etc.;
- circumventing, cracking, or evading free-quota or subscription-verification technical measures.
If you violate the above, we may, depending on severity, restrict features, suspend, or terminate service, and reserve the right to pursue legal remedies.
5. AI-Generated Content Disclaimer
Amount parsing, category suggestions, and statistical analysis generated by large language models may be inaccurate, incomplete, or inappropriate. Such content is for personal bookkeeping reference only and does not constitute financial, tax, legal, or other professional advice. Please verify before making financial decisions; you bear the consequences of relying on AI-generated content.
6. Intellectual Property
- The App and its interface, trademarks, text, graphics, code, etc. are owned by us or the respective rights holders and protected by law.
- Without our written permission, you may not copy, modify, distribute, sell, or otherwise commercially exploit any part of the App.
- Your content: transaction data you enter or record in the App remains yours. You grant us a limited license, as necessary to provide and improve the service (e.g. transmission, storage, sync).
7. Third-Party Services
The App integrates third-party services (e.g. app-store payment, LLMs). These are governed by their own terms and policies, and we are not responsible for their availability or performance. See the App's Privacy Policy.
8. Changes, Interruption & Termination
- We may suspend or interrupt service for upgrades, maintenance, third-party reasons, or force majeure, with reasonable advance notice where practicable;
- we may adjust, suspend, or terminate all or part of the service based on law or operational strategy;
- you may stop using the App and delete your account at any time.
9. Disclaimers & Limitation of Liability
- The App is provided on an "as is" and "as available" basis; we do not warrant that the service will be uninterrupted, error-free, or meet your specific needs;
- to the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential losses arising from your use of or inability to use the App;
- matters not covered by these Terms, and the scope of our liability, are governed by the mandatory provisions of applicable law.
10. Changes to These Terms
We may revise these Terms from time to time and publish the updated version and "Effective" date here. Continued use after changes take effect constitutes acceptance; if you do not agree, please stop using the App.
11. Disputes
Any dispute arising from these Terms or the App should first be resolved amicably between the parties. Nothing in these Terms affects the mandatory consumer-protection rights you have under the laws of your country or region of residence; where those mandatory rules conflict with these Terms, the mandatory rules prevail.
